WHAT TO DO WITH AN OCCUPATIONAL ACCIDENT?

Occupational accident

Previous step (mandatory for all workplaces).

Register on the web portal INPSASEL before forming the Committee on Safety and Health at Work. Failure to do this step , at the time of the accident you can not perform any steps.

Step 1: Notice in the first hour of learning of the accident through the web format INPSASEL .

If the company has a Department of Safety and Health at Work Owned , must be reported immediately to those responsible for carrying out this notice. If a Department of Safety and Health at Work Joint (for example , the case of most SMEs), our experience has shown that it is more advisable that the notification is performed by the Department of Human Resources or his substitute ( faster).

In the Department of Safety and Health at Work Owned , usually its members are trained to perform this procedure routinely. SMEs that are users of pooled departments , it is not possible for the staff of the Department of Safety and Health at Work Joint know what happened in the workplace or to move in the first hour of the accident happened to the place. It is therefore necessary that the Department of Human Resources ( or a member of the company) are trained in the use of INPSASEL formats.

Step 2: Perform a memorandum informing what happened to the Committee on Safety and Health at Work .

This memorandum should clearly inform what happened during the accident. It can be done in one to two typed pages computer, to the Committee on Safety and Health at Work. Submit the original and ask to be signed as received a copy. We suggest that previously in the committee with a stamp that says " Committee of Safety and Health at Work " of the firm or company or workplace. Thus, to deliver a letter or trade can sign the committee members and place the stamp . You should immediately call a special meeting of the committee in writing within three business days as stated in Article 76 of the Partial Regulations LOPCYMAT , so let the record show that the memorandum was received and if it proceeded or not to make a formal declaration of what happened to 24 hours ( step 3).

The employer is responsible for making the process of information to the committee within 12 hours of the accident have occurred.

Step 3 : Make the notification of an accident within 24 hours of its occurrence through the web format INPSASEL .

Filling the format can be performed by members of the Department of Safety and Health at Work . In the case of centers with own departments , it will be a routine activity . In the case of SMEs and companies with pooled services , a member of the Human Resources Department can.

Sometimes it is impossible to make the statement with all information required in the format of INPSASEL , it is in those 24 hours that the injured worker goes to emergency medical facility (or may not reach this level ) and is served , operated on , or the employee does not want to communicate , and medical details are unknown . It is always recommended that a representative accompany the worker and collect accurate information from the medical side to fill the format.

The employer is responsible for carrying out this process within 24 hours of the accident has passed.

Step 4. Personally deliver the record of having declared to the corresponding DIRESAT.

The employer or his representative must personally bear the certification issued by the online system INPSASEL to the respective DIRESAT where should require signature or seal as evidence of having been delivered.

Step 5: Research on occupational accident.

It is a full investigation of what happened through methods such as fault tree, in order to prevent the accident from recurring. Perhaps this is the most important step and is essential to inform the Committee on Safety and Health at Work is being carried out.

This research is done by the Department of Safety and Health at Work through its own staff or by hiring a third party.
